Beverly Hills Hotel. I produced the show with broadcast partner Yahoo.com. In 2000, we
produced the show live from the Century Plaza Hotel in Beverly Hills, California. That
webcast ran live for 5 hours. My broadcast partner and co-producer of the webcast was
Yahoo.com. To produce the show with Yahoo they had shipped in some technical equip-
ment to me via Airborne Express. After we had produced the show, I called Airborne to
come back and pick up the case. They picked it up and delivered it back to Yahoo.com,
who had sent to us.One year before in February of 2000, my partner Dan Jones, Rob Massopust and I had pro-
duced the show live for 5 hours. After the show we followed the same procedure. Airborne
came and picked up our package and with the return address and account number on the case,
they took the case from us and it was returned back to Dallas, Texas to our broadcast partners
at Yahoo.This past 3/31/2001 show was on a Saturday. On Tuesday April 3rd I called Airborne to sche-
dule a pickup of the case and technical equipment. They gave me the pickup # 114204, and
said that the pick up would be sometime between 1pm and 5 pm on the following day. That
day Rob Massopust, one of my technical partners helped me pack the case and we took it
to the road at Benedict Canyon in Beverly Hills, when the Airborne Van pulled up around 4 p.m.
to pick up the case. I showed the driver the paper work that was attached to the side of the
black case, with the return address being the Yahoo office in Dallas that sent the case to us
just days back. The fellow did not say I needed to sign anything, he looked at the paper work
that I showed him, said fine, opened the back door of the van, set the case in the Airborne Van
and headed up Benedict Canyon. Dan Jones, my co-producer and awarded Native American
producer was in the house and saw us take the case out and come back in the house empty
handed.Interesting note that up Benedict Canyon was a old riding trail over to the valley and was in fact
one of the last camping places and battles fought by Native Americans as they were run out
of the Los Angeles area. Just down Benedict Canyon is the Beverly Hills hotel, which was a
horse stable, that met at the bridal path that ran down Sunset Blvd., and met up with Rodeo
drive where it went up Benedict Canyon. A ride on down Rodeo Drive trail you come to Santa
Monica Blvd. where there was a rodeo arena, where cowboys would ride down from the Hills
of Beverly to shop in Beverly Hills. It is a little known fact that Rodeo drive was one of the last
streets in Los Angeles you could ride a horse.So as I watched this case of high tech Internet equipment head up the canyon in a van that would
take the Ascend router, Ethernet Crossed Cables, Power strips and Hubs back to Dallas like
some Pony Express up the canyon where ancient history was part of the webcast that we had
just taken to the world by webcasting the First American in the Arts Awards. Seemed to be
some modern day irony in the fire of history. click to pay visit to our coverage of webcastDays pass and I get word that the case had not reached Dallas. Thus begun a redundant maze
of phone calls and telling this story over and over to different people that Airborne Express would
refer me to. Each time there was a confusion on the numbers I was given, and I had to begin
each time and tell the story all over again. I know that I spent hours telling several different
Airborne Customer Service reps, Lost and found people, talks to people in Ohio, or where ever it
is they have their lost and found. I called and tried to find out where vans go after they have made
a pickup in Beverly Hills, and was told a warehouse in Santa Monica. I called here several times
and tried to see if they could just take a look in the building or somewhere for the case, of course
they treated me like I was some nut.After some point I was talking to Monica Gonzales. May 1st, she faxed me some forms to fill out,
those were also sent to Steven Logan at Yahoo on May 5th. We had several good long talks, I
talked to Alex in the Corp. office Claim Department and told him the saga again. I also talked to
Bria Buck in cargo claims, again telling my saga over again, and seems each time there was a
confusion on what number this record number was on. My files is growing thicker, my phone bill
going up, and I am spending as much time on this as anything I am doing in business at the time.
Also, talk to a Tanesha, and down the road would talk to a Christy Maakestad.This was becoming one of the longest redundant maze I have wondered in all my years in the
entertainment business. I can not help but first thin that a company like Airborne Express is
going to do what they can to help, because this is a important case and owned by Yahoo, which
I was sure was a BIG customer for Airborne. They were giving me the impression, though the
right hand did not seem to know what the left had was doing, that oh yes, we will get this taken
care of...Below are about 1/2 of the email that moved back and forth to Yahoo between J. Jarret
and myself. I have no doubt that I spent hours on the phone withThe first confusion began to set in as they put me through the "Account number" that was
to be used.1. First there was the shipping number # 63524387371
2. Then I was given and told to use the pick up number of # 114204
3. I was then given a reference number of # 05010006264On May 1, 2001, I was faxed a claim form to fill out. In that much of the questions to be answered
by Yahoo, and the copy of the fax that was sent to me was a blurred copy, I asked Airborne to send
a copy to Yahoo to fill out. For reasons I am not sure, it took a couple of weeks to get a copy of
this form to the guys at Yahoo. I had been given a confirmation by Steve Logan at Yahoo that they
had received the form and were going to fill it out. I was confident that he knew to send this back
to Airborne Express. On May 4th the form had been faxed to Airborne.I am given a Lost Control Department at 206-748-6660--so now I got some long distant calls to make.
I also have Monica Gonzles that is to have my records and we get to talk four or five times in the
hunt for the case that has been lost or stolen by someone at Airborne Express. A call to them
did not help, they talked about the big "lost and found" is in Ohio or somewhere back east and they
would be checking there. Many calls to Monica she is not there and I get someone that has me
tell the entire saga again, and their is always some trouble to figure out which number is the tracking
number for the case.During most of this month that had gone by I was under the impression that Airborne was doing a
search for the case. At one point I was then told that it was not found and that it would be a 60
day waiting period while a claim was filed for the value. Again, i was under the assumption that all
the paper work had moved, everybody knew all the numbers, who the parties were and what was
in the case and that Yahoo had communicated the size and description of the case. Besides I have
spent hours on the phone on this, each time I would call I would have to go through this big dog
and pony show to explain what happened.Seems they were admitting that they can not find the case and had searched warehouses and the
lost and found in Ohio, and we needed to now file this claim. So I think we have done the dance
and now we wait. I thought surly a company like Airborne would have a relationship and see
Yahoo as a big customer and do what was right to pay the claim for the equipment the I think
they admitted they lost, cause they could not find it, and my partner Rob and I saw them last
drive up the canyon with the case.I put this on a back burner and went about my business. We had technical problems with the
Faita show and had lost money, so I had many fires to put out and things to cover. The hours this
was taking and the off the wall run-arounds that Airborne was giving me was something I did not
need at the time...to say the least. I had other things that I needed to discuss and work out with
Yahoo and Faita on the final numbers and other things revolving around the show, but this took
a front burner and Jon and I could not talk about anything else.I was looking at it with only these things that could have happened. For I believe my eyes and the
eyes of my partner Rob, when we say the guy take the case put it in the Airborne Express van and
hightail it up the canyon in one of those UPS service grab the package and run cause we are in
such a hurry the plane may leave any minute. He gave us no paperwork after looking at what we
showed him on the case and agreed that it was all he needed, and was gone.1. Either the driver stole the case.
2. Someone at the warehouse in Santa Monica stole it.
3. Or Airborne Express lost it somewhere in route to Dallas.
4. Or it made it to Yahoo in Dallas and got lost in their receiving records.
5. Or, someone at Yahoo stole it.
6. I knew that I did not have it, I believe my own two eyes and those of my

Time passes, we are waiting the understood 60 days while the claim is filed.
Now with this passing of time I get a notice from Jon if we have heard anything on the filing.
I give a call to Airborne and find myself again having to tell the long saga. Takes some time
to find out where the records on the account are. I am then told that they have not found
or received the forms that I was told was faxed from Yahoo to Airborne back in May.So here we go again, I am now talking to different people and they are trying to find the
case. I am told that we need to file the case again...I have been telling this old story to new
people every time I call.. I am back with Yahoo and trying to coordinate Airborne getting a
copy of the forms to Yahoo. NOW WE HAVE TO WAIT ANOTHER 60 DAYS...MEANWHILE BACK AT THE RANCH UP THE CANYON, where the high tech case
left the Indian campground in a Airborne Express van to a destiny that has taken hours
and hours of many professionals to track down and spend time on phones, emails and fax
machines trying to find this equipment that in fact was lost or stolen from us by Airborne
Express...By this time the entire deal has put some aspects of my relationship with Jon and Yahoo
in a negative stance. We have not been able to move ahead on some projects and I am
very frustrated that a company like Airborne Express, the big guys, who I would think
would value a relationship with Yahoo.com, and that I would think would support the fact
that the Native American people that this show was to benefit, or my company for that
matter, who did the show at a lost, would then be the people that the two big companies
would begin to look at and demand to pay for this property that was clearly lost or stolen
by Airborne Express. Go figure...

just in brief, and later this afternoon and tonight when I have more time, I am going to write up a more
full report on the router saga. Lord the time on the phone and then the waits...at this time Tanesha is
faxing to your attention a Claim Form. Tanesha is in Monica Gonzales' office, where I have been
communicating since back in April when we went on this goose hunt. I will send you all the dates and
numbers of contacts later...right now just get this sent back to them in the claims department, with invoice of what was in the case
and we will then be on the 30 to 60 day road that I thought we were close to when I called them last
week to find out that they never received back the form, I am sure that Steven Logan told me back
around May 1 that he did in fact got a copy of the form. He and I talked a couple of times back during
that time... anyway...

So it is now August, five months from when this all began. We are going to now have
to wait another time period to go and file the claim all over again. I have to spend time
to make sure the forms get from Airborne to Yahoo and this time that they are going to
get sent back to Airborne so the process that I thought had started 60 days ago, starts
all over again.TIME PASSES AGAIN...
Now I am on the phone to a Alex. A few days later I am talking to another lady. I have
to do some traveling, I have Yahoo send me copies of what they have been sent that
seems to them that the case is being denied. I just get copies of the forms that they filled
out. I then get in copy again with Airborne and ask them to send me what mail was sent
out, and that I need to talk to a supervisor, or a lawyer with the company. I said that I
did not want to talk to customer service any longer. I am told that someone would call
me the next day. I get no call.A few days later I get a copy of a letter dated back on
September 4, 2001

So here it is nine (10) months from the time that the last First American In The Arts
Awards show was produced. In this high-tech world in which hours and hours have
been spent on the phone, 2 eye witnesses saw Airborne Express leave with the pro-
perty, after a maze of confusion in numbers, faxes, requests, phone calls and emails,
hours on our part and that of Yahoo, trying to find some equipment that was last put
in the hands of Airborne, they just say "Investigation of your claim shows we cannot
accept liability."I have lost some very important time working on a more positive level with Yahoo
over the way that Airborne Express took care of this event. It has taken my
associate at Yahoo.com away from many important things he was to do over the
time he and I had to deal with this. It took us from the very creative process that
we had begun and the deals that we were working on. It has put him in a negative
light with some of his people and he is having to take heat himself.I want to take my claim further beyond the off of Mr. Louie Pinpin. Please inform
me as to the name of a legal council with your company that I can talk to further
and communicate about this matter.I run the website the StudioClub.com. I have survived the Internet shakedown
the past year, which has been somewhat a blessing from somewhere, plus some
hard work with our little company. I come from Texas where I work with the likes
of outlaws like Willie Nelson and many other outlaws of Country music. I have
been a pioneer of the online webcasting business and I am not going to let a
huge company like Airborne Express take me south to the cleaners on a south
